For default in the payment of principal and interest now past due on a certain promissory note dated December 23, 2008 and secured by a deed of trust dated December 23, 2008 signed by Ernest A. Irwin, a single person, and recorded on January 5, 2009, as Document 090006 in the Office of the Recorder of Deeds for Douglas County, Missouri, Lee J. Viorel, III will, at the request of the legal holder thereof, on Friday, the 7th day of February, 2014, between the hours of 9 o’clock a.m. and 5 o’clock p.m., specifically at 1 o’clock p.m. at the North Door of the Douglas County Courthouse, located at 203 Southeast 2nd Avenue, in the City of Ava, Missouri, sell at public vendue to the highest bidder for cash, the property in the deed of trust described as:
A part of the NE1/4 NW1/4 of Section 13, Township 26, Range 16 more accurately described as commencing at the SW corner of said NE1/4 NW1/4 thence North 991.66 feet, thence East 91.68 feet to the true place of beginning, thence South 86 degrees 25 minutes East 223.45 feet, thence North 19 degrees 50 minutes East 246.92 feet, thence North 12 degrees 05 minutes West 102.28 feet, thence West 325.6 feet to the East right of way line of Highway #14, thence Southeasterly along the East right of way of Highway #14 approximately 322.0 feet to the true point of beginning.
The above described tract is subject to an easement for a right of way consisting of a strip of land 26 feet in equal width across the entire north side extending from the East right of way line of Rt. #14 to the most Easterly side of the described tract of land. All in Douglas County, Missouri.
