IN RE: Darrel R. Newberry and Dawn M. Newberry, Husband and Wife Trustee’s Sale:

 

For default in payment of debt and performance of obligation secured by Deed of Trust executed by Darrel R. Newberry and Dawn M. Newberry, Husband and Wife dated January 24, 2007 and recorded in the Office of the Recorder of Deeds of Douglas County, Missouri in Book 460, Page 710 the undersigned Successor Trustee, at the request of the legal holder of said Note will on Monday, July 15, 2013 between the hours of 9:00 a.m. and 5:00 p.m., (at the specific time of 4:10 PM), at the North Front Door of the Court House, City of Ava, County of Douglas, State of Missouri, sell at public vendue to the highest bidder for cash the following described real estate, described in said Deed of Trust, and situated in Douglas County, State of Missouri, to wit:

A PART OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 1, TOWNSHIP 27, RANGE 13, DESCRIBED AS BEGINNING AT THE INTERSECTION OF THE CENTERLINE OF AS HIGHWAY AND THE SOUTH LINE OF SAID SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER, THENCE EAST 500 FEET, THENCE NORTHERLY, PARALLEL WITH SAID HIGHWAY AE 500 FEET, THENCE WEST 500 FEET, MORE OR LESS TO THE CENTERLINE OF SAID HIGHWAY, THENCE SOUTHERLY TO THE PLACE OF BEGINNING.

BEING ALL OF THAT CERTAIN PROPERTY CONVEYED TO DARREL R. NEWBERRY AND DAWN M. NEWBERRY FROM CHARLES R. NEWBERRY AND CAROLYN NEWBERRY, BY DEED DATED 10/16/02 AND RECORDED 10/17/02 IN DEED BOOK 359, PAGE 70 OF OFFICIAL RECORDS. [MORE ACCURATELY DESCRIBED BY SCRIVENERS ERROR AFFIDAVIT RECORDED 5/30/2013 IN INSTRUMENT# 131016 AS FOLLOWS: A PART OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 1, TOWNSHIP 27, RANGE 13, DOUGLAS COUNTY, MISSOURI, DESCRIBED AS BEGINNING AT THE INTERSECTION OF THE CENTERLINE OF AE HIGHWAY AND THE SOUTH LINE OF SAID SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER, THENCE EAST 500 FEET, THENCE NORTHERLY, PARALLEL WITH SAID HIGHWAY AE 500 FEET, THENCE WEST 500 FEET, MORE OR LESS TO THE CENTERLINE OF SAID HIGHWAY, THENCE SOUTHERLY TO THE PLACE OF BEGINNING, EXCEPT THAT PART IN STREETS AND ROADS.]
