NOTICE OF TRUSTEE’S SALE
Default having been made in the payment of the debt and the performance of the obligations of the notes described in and secured by a Deed of Trust dated August 2, 2011 executed by Jack R. Boyle, Jr., as duly authorized agent of Cummins Sandborn Land Co, LLC, and recorded in the Office of the Recorder of Deeds of Douglas County, Missouri, on August 4, 2011 at 4:11 P.M., and recorded as Document No. 111197, conveying to the Trustee property including the following described property in Douglas County, Missouri, to-wit:
A tract of land situated in a portion of the Southwest Quarter of the Southeast Quarter of the Southwest Quarter of Section 13, Township 26, Range 13, In Douglas County, Missouri to-wit:
Beginning at the Southwest corner of said SW ¼ of SE ¼ of SW ¼ of said Section 13, thence easterly along the South line of Section 13 a distance of 35 feet; thence northerly 15 feet to an intersection point of the northerly right-of-way line of and existing east-west Douglas County road with the existing easterly right-of-way line of an existing north-south Douglas County road for the true point of beginning of this tract; thence continue northerly along said easterly right-of-way line of said country road for 208.71 feet; thence departing from said right-of-way line, run easterly 208.71 feet; thence run southerly 208.71 feet to a point of the northerly right-of-way line of said east-west Douglas County road; thence run westerly along said northerly right-of-way line of said county road 208.71 feet to the true point of beginning.
At the request of the legal holder of said note who has elected to declare the entire indebtedness due and payable, and in accordance with the provisions of the said Deed of Trust, the undersigned Trustee will on December 28, 2012, to-wit at 3:30 p.m., sell said property at public venue to the highest bidder for cash at the steps of the County Court House, in the City of Ava, Douglas County, Missouri, to satisfy said note and costs.
