NOTICE OF TRUSTEE’S SALE
WHEREAS, Michael Lawson, a single person and Etta Mecke, a single person, by their Deed of Trust dated December 28, 2006, and recorded in the Recorder’s Office for Douglas County, Missouri, in Book 459 at Pages 63-69, conveyed to Daniel P. Wade, Trustee, the following described real estate, situated in the County of Douglas, State of Missouri, to-wit:
All that part of the SW ¼ SE ¼ of Section 18, Township 26, Range 15, described as beginning at a point 210 feet East of the Northwest corner and run thence East 105 feet, thence run South 210 feet, thence run West 105 feet, thence run North 210 feet and to the point of beginning.
That part of the SW ¼ SE ¼ of Section 18, Township 26, Range 15, described as beginning at the Northwest corner of said SW ¼ SE ¼; thence run North 89 degrees 32 minutes 14 seconds East, along the North Line of said SW ¼ SE ¼, a distance of 315.00 feet for a NEW POINT OF BEGINNING; thence continue North 89 degrees 32 minutes 14 seconds East, along said North line a distance of 210.00 feet; thence South 0 degrees 32 minutes 48 seconds West, a distance of 5.79 feet leaving said North line, to a point on the Southerly right-of-way line of an existing road; thence continue South 0 degrees 32 minutes 48 seconds West, leaving said right of way line a distance of 204.21 feet; thence South 89 degrees 32 minutes 00 seconds West, a distance of 210.00 feet; thence North 0 degrees 32 minutes 48 seconds East, a distance of 204.38 feet to a point on the Southerly right of way line of said road; thence continue North 0 degrees 32 minutes 48 seconds East, a distance of 5.62 feet to the NEW POINT OF BEGINNING.
which conveyance was made to said Daniel P. Wade, Trustee, in Trust, to secure the payment of a certain note in said Deed of Trust described; and
WHEREAS, it is provided in and by the terms of said Deed of Trust that in case of the absence, death, or refusal to act, or disability in anywise, of the Trustee, at the request of the legal holder of said note, may request another individual to proceed to sell the property hereinbefore described; and
WHEREAS, Daniel P. Wade has resigned said trust and refused to act as Trustee; and
WHEREAS, Holly Wickware has been appointed Successor Trustee by the holder of the note; and
WHEREAS, default was made and still continues in the payment of said note.
NOW, THEREFORE, at the request of the legal holder of said note, and in pursuance of the provisions of said Deed of Trust, the undersigned Successor Trustee will sell the property above described at public venue, to the highest bidder for cash, at the North Door of the Douglas County Courthouse in the City of Ava, State of Missouri, on Friday, December 2, 2011 between the hours of 9:00 a.m. and 5:00 p.m., to-wit: at 1:00 p.m., for the purpose of satisfying said indebtedness and the cost of executing this trust.
