NOTICE OF TRUSTEE’S SALE
WHEREAS, James A. Morris and Kerry Morris, as husband and wife, grantors, by their deed of trust dated August 30, 2010, and recorded on September 2, 2010, Book/Instrument #101291, Pages 1 through 7, in the office of the Recorder of Deeds for Douglas County, Missouri, conveyed the following-described property situated in the County of Douglas, State of Missouri, to-wit:
THE SOUTH 990 FEET OF THE S1/2 NE1/4 OF SECTION 12, TOWNSHIP 26, RANGE 15, BEING ALSO SOMETIMES DESCRIBED AS THE SOUTH 60 ACRES OF THE S1/2 OF THE NE1/4.
ALSO THE NORTH 165 FEET OF THE N1/2 SE1/4 OF SECTION 12, TOWNSHIP 26, RANGE 15, BEING ALSO SOMETIMES DESCRIBED AS THE NORTH 10 ACRES OF THE N1/2 OF THE SE1/4.
ALSO, THE “OLD ROAD” 25 FEET IN WIDTH RUNNING WEST FROM THE COUNTY ROAD AS DESCRIBED IN THE S1/2 LOT 2 OF THE NW1/4 (SW1/4 NW14/) IN SECTION 7, TOWNNSHIP 26, RANGE 14, AS RECORDED IN GENERAL WARRANTY DEED IN RECORD BOOK 415 AT PAGES 123-125 AND IN BOOK 416 AT PAGE 90.
BEING BETTER DESCRIBED AS: ALL OF THE SOUTH 25 FEET OF THE FOLLOWING DESCRIBED LEGAL DESCRIPTION: ALL THAT PART OF THE S1/2 LOT 2 OF THE NW ¼ (SW1/4NW1/4) AND THE N1/2 LOT 2 OF THE SW ¼ (NW1/4SW1/4) IN SECTION 7,TOWNSHIP 26, RANGE 14 DESCRIBED AS BEGINNING AT THE POINT WHERE THE CREEK CROSSES THE WEST LINE OF THE SW1/4NW1/4, SAID POINT BEING APPROXIMATELY 150 FEET SOUTH OF THE NORTHWEST CORNER OF SAID SW1/4 NW1/4, THENCE FOLLOW SAID CREEK IN AN EASTERLY DIRECTION AND TO THE POINT WHERE THE CREEK HITS THE WEST SIDE OF THE COUNTY ROAD, SAID POINT BEING APPROXIMATELY 320 FEET SOUTHEAST OF THE POINT WHERE THE COUNTY ROAD CROSSES THE NORTH LINE OF SAID FORTY, THENCE FOLLOW THE COUNTY ROAD IN A SOUTHEASTERLY DIRECTION AND TO THE EAST LINE OF SAID SW ¼ NW ¼, THENCE FOLLOW THE COUNTY ROAD, SOUTH, ALONG THE FORTY LINE AND TO THE POINT WHERE AN “OLD ROAD” INTERSECTS THE WEST SIDE OF THE COUNTY ROAD, THENCE FOLLOW ALONG THE SOUTH SIDE OF THE “OLD ROAD” IN A WESTERLY DIRECTION AND TO A POINT ON THE WEST LINE OF THE NW1/4 SW1/4, THENCE RUN NORTH ALONG THE WEST LINE OF THE NW1/4 SW1/4 AND THE SW1/4 NW ¼ OF SECTION 7, TOWNSHIP 26, RANGE 14 AND TO THE POINT OF BEGINNING.
To a Trustee named in said deed of trust, in trust, to secure the payment of one note in said deed of trust described; and
WHEREAS, default was made and still continues in the payment of said note;
NOW THEREFORE, at the request of the legal holder of said note, who has elected to declare the entire debt due and payable, the undersigned Trustee, in accordance with the provisions of said deed of trust, will sell the property above described at public vendue to the highest bidder for cash, at the North Front Door of the Douglas County Courthouse, 203 SE Second Avenue, in the City of Ava, State of Missouri on Wednesday, November 30, 2011, between the hours of 9:00 a.m. in the forenoon and 5:00 p.m. in the afternoon and as near to 1:00 p.m. in the afternoon as is practical for the purpose of satisfying said indebtedness and the cost of executing this trust.
