NOTICE OF TRUSTEE’S SALE
Default having been made in the payment of the Note described in and secured by a Deed of Trust, dated June 30, 2006, executed by Robert L. Barnett and Lisa A. Barnett, Husband and Wife, and recorded on July 6, 2006, in the Office of the Recorder of Deeds of Douglas County, Missouri, in Book 451 at Page 27, and conveying to the trustee named therein the property in Douglas County, Missouri, to-wit:
THE EAST 10 ACRES OF THE SE ¼ NW ¼; THE EAST 10 ACRES OF THE NE ¼ SW ¼; THE SW ¼ NE ¼, EXCEPT ALL THAT PART OF SAID SW ¼ NE ¼ WHICH LIES EAST OF THE CENTER LINE OF BEAVER CREEK; ALL OF THE W ½ SE ¼ WHICH LIES NORTH OF THE CENTER OF “COWSKIN CREEK”, EXCEPT THAT PART OF THE NW ¼ SE ¼ DESCRIBED AS BEGINNING AT A POINT 461.5 FEET NORTH OF THE SW CORNER OF THE NORTH ¾ OF THE NE ¼ SE ¼ OF SECTION 13, TOWNSHIP 26, RANGE 17, (BEING 30 FEET NORTH OF THE NORTH LINE OF THE “CEMETARY” TRACT), FOR A POINT OF BEGINNING, THENCE RUN NORTH 87 DEGREES 23 MINUTES 18 SECONDS WEST, 360 FEET, THENCE RUN SOUTH 00 DEGREES 00 MINUTES 33 SECONDS EAST, 214.04 FEET, THENCE RUN SOUTH 88 DEGREES 41 MINUTES 27 SECONDS WEST, 519.63 FEET AND CONTINUE SOUTH 88 DEGREES, 41 MINUTES, 27 SECONDS WEST, APPROXIMATELY 60 FEET TO THE CENTER LINE OF BEAVER CREEK, THENCE FOLLOW SAID CENTERLINE OF “BEAVER CREEK” IN A NORTHERLY DIRECTION AND TO THE INTERSECTION WITH THE NORTH LINE OF THE NW ¼ SE ¼, THENCE RUN EAST AND TO THE NE CORNER OF SAID NW ¼ SE ¼, THENCE RUN SOUTH 00 DEGREES 00 MINUTES 33 SECONDS EAST, 539.49 FEET AND TO THE TRUE POINT OF BEGINNING OF SAID EXCEPTION, ALSO EXCEPT A PART OF THE NW ¼ SE ¼ DESCRIBED AS BEGINNING AT A POINT 214.5 FEET NORTH OF THE SW CORNER OF THE NORTH ¾ OF THE NE ¼ SE ¼, THENCE RUN NORTH 217 FEET, THENCE RUN WEST 136 FEET, THENCE RUN SOUTH 217 FEET, THENCE RUN EAST 136 FEET AND TO THE POINT OF BEGINNING OF SAID EXCEPTION; THAT PART OF THE SE ¼ SW ¼ WHICH LIES NORTH OF THE COUNTY ROAD AND NORTH AND EAST OF THE WILLIAMS HOLLOW ROAD. ALL ABOVE LAND BEING IN SECTION 13, TOWNSHIP 26, RANGE 17. EXCEPT ALL THAT PART OF SAID LAND LYING WEST OF THE CENTERLINE OF BEAVER CREEK.
at the request of the legal holder of said Note who has elected to accelerate and declare the entire indebtedness due and payable, and in accordance with the provisions of the said Deed of Trust, the undersigned Successor Trustee will, on May 27, 2011, at 1:00 P.M., sell said property at public vendue to the highest bidder for cash at the North front door of the Douglas County Courthouse, in the City of Ava, County of Douglas, State of Missouri, to satisfy said Note and costs.
