NOTICE OF TRUSTEE’S SALE

For default in the payment of debt secured by Deed of Trust executed by Nylene R. Hicks and Jerry K. Hicks, husband and wife, dated August 14, 2008 and recorded on August 15, 2008 as Document No. 081753, Office of Recorder of Deeds, Douglas County, Missouri, the undersigned Successor Trustee will, on May 20, 2011, between the hours of 9:00 o’clock A.M. and 5:00 P.M. (foreclosure sales in Douglas County are customarily held at 11:30AM), at the Douglas County Courthouse, 203 SE Second Avenue, North Front door, Ava, MO 65608, sell at public venue to the highest bidder for cash:

All that part of the NW1/4NW1/4 of Section 12, Township 25, Range 15, which lies East of State

Highway “P”, EXCEPT that part of the NW1/4NW1/4 of said Section 12, Township 25, Range 15, described as commencing at the Southeast corner of said forty and run North and to the “Old County. Road” (sometimes referred to as “County Road to School House”), as now located, thence following said “Old County Road” in a Westerly direction and to the East right-of-way line of Farm-to-Market Highway “P” thence following said right-of-way of said Highway “P” in a southerly direction and to the south line of said forty acre tract, thence run East, along said forty line and to the point of beginning of said EXCEPTION.

SAID EXCEPTION being also sometimes described as a part of the NW1/4NW1/4 of Section 12, Township 25, Range 15, beginning at the point where the “County Road to School House” intersects the East right-of-way line of State Highway “P”, from this point run straight East and to the East line of said forty, thence  run South and to the SE corner of said forty, thence run West and to the East right-of-way line of State Highway “P”, thence follow said Highway “P” in a Northerly direction and to the point or beginning of said EXCEPTION

The above legal description taken verbatim from Deed of Trust contains an inherent scrivener’s error. The correct legal is as follows:
