NOTICE OF TRUSTEE’S SALE
WHEREAS, Tina D. Norton, a single person, by her Deed of Trust dated October 28, 1999, and recorded in the Recorder’s Office for Douglas County, Missouri, in Record Book 332 at Pages 135-136 conveyed to Fybar Service Corporation, Trustee, the following described real estate, situated in the County of Douglas, State of Missouri, to-wit:
That part of the SE ¼ NE ¼ of Section 10, Township 25, Range 16 described as commencing at the Southeast corner of said forty and run thence North 235 feet, thence run West 820 feet, being at a point 500 feet East of the West line of said forty, thence run South 235 feet and thence run East 820 feet and to the place of beginning; all in Douglas County, Missouri.
Subject to right of way for all public and county roads, as they now run.
Which conveyance was made to said Fybar Service Corporation, Trustee, in Trust, to secure the payment of a certain note in said Deed of Trust described; and
WHEREAS, it is provided in and by the terms of said Deed of Trust that in case of the absence, death, or refusal to act, or disability in anywise, of the Trustee, at the request of the legal holder of said note, may request another individual to proceed to sell the property hereinbefore described; and
WHEREAS, Fybar Service Corporation has resigned said trust and refused to act as Trustee; and
WHEREAS, Christopher D. Wade has been appointed Successor Trustee by the holder of the note; and
WHEREAS, default was made and still continues in the payment of said note.
NOW, THEREFORE, at the request of the legal holder of said note, and in pursuance of the provisions of said Deed of Trust, the undersigned Successor Trustee will sell the property above described at public venue, to the highest bidder for cash, at the North Door of the Douglas County Courthouse in the City of Ava, State of Missouri, on Friday, April 1, 2011 between the hours of 9:00 A.M. and 5:00 P.M., to-wit: at 1:00 P.M., for the purpose of satisfying said indebtedness and the cost of executing this trust.
