In Re: Wesley E. Wallace, Husband and Wife; Sherry G. Wallace, Wife and Husband
TRUSTEE’S SALE – For default in the payment of debt and performance of obligation described in and secured by Deed of Trust executed by Wesley E. Wallace, Husband and Wife; Sherry G. Wallace, Wife and Husband dated 02/28/2007, and recorded on 03/05/2007 Book 461 Page 450 in the office of the Recorder of Deed for Douglas County, MISSOURI, the un-dersigned Successor Trustee, at the request of the legal holder of the debt, who has elected to declare the entire debt due and payable, will on Friday, 11/19/2010 between the hours of 9:00 a.m. and 5:00 p.m. (1:00 p.m.) at the North Front Door of the Douglas County Courthouse, 203 SE 2nd Ave. Ava, MO 65608, sell at public venue to the highest bidder for cash, the realty described in said deed of trust, to wit:
A PART OF LOT 5 OF THE H.M. MILLER ADDITION TO THE CITY OF AVA, MISSOURI, AS PER PLAT OF RECORD IN PLAT BOOK 1, PAGE 5, IN THE OFFICE OF THE DOUGLAS COUNTY RECORDER, AND DESCRIBED AS: COMMENCING AT THE NW CORNER OF SAID LOT 5 AND RUN THENCE EAST 143.86 FEET, THENCE RUN SOUTH 149.53 FEET AND TO THE POINT OF BEGINNING OF THE TRACT TO BE DESCRIBED, RUN THENCE SOUTH 149.53 FEET, THENCE RUN WEST 143.01 FEET AND TO THE WEST LINE OF SAID LOT 5, THENCE RUN NORTH ALONG SAID LINE AND TO A POINT DUE WEST OF THE POINT OF BEGINNING, THENCE RUN EAST AND TO THE POINT OF BEGINNING. TOGETHER WITH AN EASEMENT FOR INGRESS AND EGRESS OVER AND ACROSS THE EAST 30 FEET OF THE WEST 70 FEET OF LOT 4. H.M. MILLER ADDITION AND ALSO ACROSS THE WEST 30 FEET OF THE NORTH 149.53 FEET OF LOT 5 H.M. MILLER ADDITION TO THE CITY OF AVA, MISSOURI, AS PER PLAT OF RECORD IN PLAT BOOK 1, PAGE 5, IN THE OFFICE OF THE DOUGLAS COUNTY RECORDER.
Subject to easements, restrictions, reservations, and covenants, if any, to satisfy said debt and cost.
