NOTICE OF TRUSTEE’S SALE
WHEREAS, Martha Doughtery (who died February 12, 2010), a single person and unremarried widow and surviving tenant by the entireties with James L. Doughtery who died Septem-ber 24, 1998, by her Deed of Trust dated January 9, 2009, and recorded in the Recorder’s Office for Douglas County, Missouri, as Document #090090, conveyed to Daniel P. Wade, Trustee, the following described real estate, situated in the County of Doug-las, State of Missouri, to-wit:
The West 40 feet of Lot 4; the East 75 feet of Lot 9; A part of Lot 8 de-scribed as commencing at the Northeast corner thereof and running thence West 115 feet, thence run South 60 feet, thence run East 115 feet and thence run North 60 feet and to the point of begin-ning; All in H.M. Miller’s Addition to the City of Ava, Missouri, as per plat of record in Plat Book 1 at Page 5 in the office of the Douglas County Recorder. Subject to all easements, right-of-ways, restrictions, or reservations of record.
Which conveyance was made to said Daniel P. Wade, Trustee, in Trust, to secure the payment of a certain note in said Deed of Trust described; and
WHEREAS, it is provided in and by the terms of said Deed of Trust that in case of the absence, death or refusal to act, or disability in anywise, of the Trustee, at the request of the legal holder of said note, may request an-other individual to proceed to sell the property hereinbefore described; and
WHEREAS, Daniel P. Wade has re-signed said trust and refused to act as holder of the note; and
WHEREAS, Holly Wickware has been appointed Successor Trustee by the holder of the note; and
WHEREAS, default was made and still continues in the payment of said note.
NOW, THEREFORE, at the request of the legal holder of said note, and in pursuance of the provisions of said Deed of Trust, the undersigned Succes-sor Trustee will sell property above described at public venue, to the high-est bidder for cash, at the North Door of the Douglas County Courthouse in the City of Ava, State of Missouri, on Friday, October 22, 2010 between the hours of 9:00 A.M. and 5:00 P.M., to-wit at 1:00 P.M., for the purpose of satisfying said indebtedness and the cost of executing this trust.
