NOTICE OF TRUSTEE’S SALE

WHEREAS, Robert Snelson and Mary Lou Snelson, Husband and Wife, by their Correction Deed of Trust dated August 12, 2010, and recorded in the Recorder’s Office for Douglas County, Missouri, In Document No. 101192, conveyed to Mark A. Stephens, Trustee, the following described real estate, situated in the County of Douglas, State of Missouri, to-wit:

TRACT II

A part of the E ½ of the SW ¼ of Section 29, Township 26 North, Range 16 West, described as follows: Commencing at the NW corner of said E ½ of SW ¼, thence South 01°52’00” West, 1,391.69 feet; thence North 54°52’43” East, 428.97 feet to the POINT OF BEGINNING; thence South 37°19’01” East, 841.56 feet to the North right-of-way line of County Road No. 404; thence along said North right-of-way line North 57°05’57” East, 161.38 feet; thence North 47°30’02” East, 76.71 feet; thence North 53°21’59” East, 20.88 feet; thence departing said North right-of-way line North 37°19’01’ West, 837.41 feet; thence South 54°52’43” West, 258.37 feet to the point of beginning.

TRACT III

A part of the E ½ of the SW ¼ of Section 29, Township 26 North, Range 16 West, described as follows: Commencing at the NW corner of said E ½ of SW 1/4, thence South 01°52’00” West, 1,391.69 feet; thence North 54°52’43” East. 687.34 feet to the POINT OF BEGINNING; thence South 37°19’01” East, 837.41 feet to the North right-of-way line of County Road No. 404; thence along said North right-of-way line North 53°21’59” East. 69.41 feet; thence North 63°00’19” East, 191.23 feet; thence departing said North right-of-way line North 37°19’01” West, 862.63 feet; thence South 54°52’43” West, 257.73 feet to the point of beginning.

TRACT IV

A part of the E ½ of the SW ¼ and a part of the W ½ of the SE ¼ all in Section 29, Township 26 North, Range 16 West, described as follows: Commencing at the NW corner of said E ½ of SW 1/4; thence South 01°52’00” West, 1,391.69 feet; thence North 54°52’43” East, 945.07 feet to the point of beginning; thence South 37°19’01” East, 962.63 feet to the North right-of-way line of County Road No. 404; thence along said North right-of-way line North 63°00’19” East, 114.29 feet; thence North 58°37’25” East, 136.48 feet; thence departing said North right-of-way line North 37°19’01” West, 887.72 feet; thence South 54°52’43” West, 248.37 feet to the point of beginning.

Which conveyance was made to said Mark A. Stephens, Trustee, to secure the payment of a certain note in said Deed of Trust described; and

WHEREAS, it is provided in and by the terms of said Deed of Trust that in case of the absence, death, or refusal to act, or disability in anywise, of the Trustee, at the request of the legal holder of said note, may request another individual to proceed to sell the property hereinbefore described; and

WHEREAS, Mark A. Stephens has resigned said trust and refused to act as Trustee; and

WHEREAS, Christopher D. Wade has been appointed Successor Trustee by the holder of the note; and

WHEREAS, default was made and still continues in the payment of said note.

NOW, THEREFORE, at the request of the legal holder of said note, and in pursuance of the provisions of said Deed of Trust, the undersigned Successor Trustee will sell the property above described at public venue, to the highest bidder for cash, at the North Door of the Douglas County Courthouse in the City of Ava, State of Missouri, on Friday, September 10, 2010 between the hours of 9:00 A.M. and 5:00 P.M., to-wit: at 1:00 P.M., for the purpose of satisfying said indebtedness and the cost of executing this trust.
